無害通過制度的發(fā)展及其現(xiàn)狀研究

摘  要

無害通過權(quán)問題1直是世界各國關(guān)注的焦點之1，它是傳統(tǒng)海洋法賦予外國船舶無害通過1國領(lǐng)海的1項重要權(quán)利，是對國家領(lǐng)土主權(quán)的限制，也是目前海洋法的重要內(nèi)容之1。本文主要通過研究無害通過制度的歷史發(fā)展過程，論述了現(xiàn)階段無害通過權(quán)與國家領(lǐng)土主權(quán)的沖突問題和解決方案以及無害通過對國際人道主義的意義。

ABSTRACT

The problem of the right of Innocent Passage was one of the world focus, which is the Traditional Law of the Sea gives foreign vessels of innocent passage through the territorial waters of a country an important right, the country’s sovereignty and territorial restrictions, the law of the sea is currently one of the important contents. This essay mainly studies the historical development process of Innocent Passage Policy, and discussed at this stage Innocent Passage Policy and the conflict and solutions of national sovereignty. And Innocent Passage passed the significance of international humanitarian.
