論我國(guó)司法鑒定人法律責(zé)任制度的完善

摘要

司法鑒定人的法律責(zé)任是指鑒定人在違反其法定義務(wù)或者在履行職責(zé)過程中給他人造成損失的情況下，所應(yīng)承擔(dān)的法律責(zé)任。我國(guó)關(guān)于司法鑒定人法律責(zé)任制度的規(guī)定存在許多缺陷。針對(duì)這些缺陷，我們應(yīng)在在責(zé)任主體方面明確司法鑒定人的責(zé)任主體地位；刑事責(zé)任上要完善偽證罪立法，并確立藐視法庭罪；民事責(zé)任上要正確定位鑒定人，明確鑒定人民事責(zé)任性質(zhì)。行政責(zé)任方面則要加強(qiáng)立法，建立統(tǒng)1的法律規(guī)范。而且，要建立起切實(shí)可行的執(zhí)業(yè)保險(xiǎn)制度或執(zhí)業(yè)互濟(jì)制度。保障司法鑒定人法律責(zé)任制度的有效完善和執(zhí)行。

Abstract

  Determiners responsibilty of law is the responsibilty of law that determiners should take in the situation of disobeying their obligation in law or causing loss to others in the proceeding of fullfill their duty.  There are a lot of defects about the stipulates of determiners responsibilty of law system. Aiming at these defects, on responsible part, we should chang oragnation responsibilty to determiner (natural person) responsibilty; on penal responsibilty, we should improve legislation of perjury crime and establish contempt crime; on civil responsibilty, we should position the determiner correctly and identify the property of determiners civil responsibiltyclearly. On administration we should strengthen legislation and establish unified criterion of law. Further more, we should establish practical insurance system and mutual benefit system in carrying out business and ensure efficient improvement and implement.
