英美法系國家陪審制度研究

摘要

陪審制度是指由非法律職業(yè)者參加法庭審判，與法官共同行使審判權(quán)的制度。根據(jù)其形式的不同，分為陪審團制度與參審制度。無論是陪審團制還是參審制,都與1國民主制度相聯(lián),而且兩者各有弊端。陪審制度作為英美法系司法的重要組成部分，對完善我國人民陪審員制度具有很重要的借鑒意義。

Abstract

The Jury system means that the non-participation of the legal profession courtroom with a judge to exercise jurisdiction of the common system. According to the different forms, Jury system had been separated into two parts, the Jury Trial System and the Reference System. Whether the jury system is judged or not, it has the relation with countrys democratic system, and both of them have their own disadvantages. Jury system as a common-law judicial important component of China to improve the peoples jury system is very important to learn.
